These terms of service seem strong, but please note that they are only here to limit my liability. Please feel free to suggest better terms and conditions, or suggest corrections.
Terms of service (“TOS”)
Acceptance of terms
“you” means an individual or representative agreeing to these terms and conditions by providing your twitter credentials (either via OAuth or basic authentication)
“us”, “we” and “(this/the) application” refers to the Twipler web application, it’s service and interaction and the individuals providing the service (Ian Quigley).
These TOS may be updated by at any time by us, from time to time without notice to you. A web link to the most recent and applicable TOS will be presented at the login stage for this application.
These TOS are in addition to the Twitter TOS and do not replace them.
Recognising the global nature of the Internet, you agree to comply with all local laws and rules regarding online conduct and acceptable.
You agree to indemnify and hold Twipler (Ian Quigley and associates) affiliates, officers, agents, co-branders and other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post to or transmit through the Services, your use of the Services, your connection to the Services, your violation of the TOS, or your violation of any rights of another.
Reliability
The application is provided “as is” without any warranty without even the implied warranty of merchantability or fitness for a particular purpose. The application is currently in development and is untested. Be warned that there are likely to be defects and issues. The application is not hosted on our own hardware, so we are reliant on a third party to provide you this service. While every effort is made to provide you a working, defect free and available service, we cannot guarantee and will not be liable for this.
Privacy
The privacy of your personal information is important to us. We never sell or trade your personal information to third parties. We may provide anonymous user statistics or examples as well as making public information we believe to already be publicly available.
By logging into this service you will create a digital footprint with the service.
Your digital footprint will include and is not limited to the storing of log files, general analytic information (IP and ISP information, browser configuration etc). We may also store cookies with your browser. User credentials to login to the Twitter service may be stored for the purpose of linking accounts or for other optional mechanisms.
Reserved as a last resort, for the purposes of resolving errors, maintenance or debugging service issues your account and information may be accessed.
User Generated Content.
Through this website you are able to link to other websites which are not under our control. We have no control over the nature or content of those sites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.
You acknowledge that all information, data, text, software, music, sound, photographs, graphics, video, messages, whether publicly posted or privately transmitted, are the sole responsibility of the person from which such content originated.
While every effort is made to maintain User Generated Content stored in the service, it may be modified, copied or deleted by us without notice. By creating or uploading content, you agree to relinquish any claims of copyright for any material you submit and that you have original copyright permission on submitted material and that such material is neither illegal nor libellous.
Twitter and Tweets
You are responsible for your use of the Service (which is linked to the Twitter Service), for any content you post to the Services, and for any consequences thereof. The content you submit, post, or display will be able to be viewed by other users of the Twitter service and through third party services and websites. You should only provide Content that you are comfortable sharing with others under these and Twitters Terms (http://twitter.com/tos)
Reliability of service
This is an untested alpha version of this software. While I have tried to make it as stable as possible I can make no guarantees for its correctness.
We may select to ban you from the service
You agree to use this software/web site AS IS, WITHOUT ANY WARRANTY without even the implied warranty of MERCHANTABILITY or FITNESS FOR A PARTICULAR PURPOSE.
Your use of the service is at your sole risk. The service is provided on an "as is" and "as available" basis.
